1. Acceptance of Terms

By accessing or using Parkly ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. What Parkly Is

Parkly is a parking discovery platform, accessible via the parkly.co.in website and the Parkly mobile apps (collectively, the "Platform"), that connects parking space owners ("Owners") with drivers looking for parking ("Users"). The Platform also provides a QR-based vehicle alert service.

Parkly is a technology platform only. We are not a parking operator, do not own or manage any parking space listed on the Platform, and do not process or mediate rental payments between Users and Owners. The Platform does not offer bookings, reservations, or guaranteed availability — Users must confirm availability and terms directly with the Owner.

Platform Pass

Purchasing a Day Pass (Rs.9) or Month Pass (Rs.49) unlocks access to view the direct contact details of all listed parking space owners during the pass period. This is a platform access fee, not a parking reservation.

Owner listings

Owners are responsible for the accuracy of their listings including availability, pricing, address, and vehicle type restrictions. Parkly does not verify listing accuracy.

Direct transactions

Parking fees are negotiated and paid directly between Users and Owners. Parkly does not process or handle parking fee payments. Any disputes over parking fees are between the User and Owner.

Listing approval and moderation

All parking listings are subject to review and approval by Parkly before appearing publicly. We may reject, unpublish, or remove any listing at our sole discretion — including for suspected fraud, incomplete information, safety concerns, or policy violations — without prior notice.

5. QR Vehicle Alert Service

The Rs.499 QR sticker is a one-time purchase (no recurring subscription) that includes a printed QR sticker shipped to the address you provide and a digital QR alert link activated for your vehicle, valid for 5 years from activation. When someone scans the sticker, an anonymous alert is sent to your registered messaging number (e.g. WhatsApp).

5.1 Emergency Alerts

An "Emergency" alert type is available alongside the standard alert categories. When the sender selects Emergency, the sender's approximate location at the moment of scan (latitude/longitude derived from the device GPS) is included in the alert sent to the vehicle owner. The sender's identity remains anonymous; only their location is shared, and only for the single alert in question.

All payments are processed by Razorpay. By making a payment, you agree to Razorpay's Terms of Service. Parkly does not store full payment card details.

Prices are in Indian Rupees (INR) inclusive of applicable taxes unless otherwise stated.

All content, design, branding, and software on the Platform is owned by or licensed to Parkly. You may not copy, reproduce, or redistribute it without written permission.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the Platform will be error-free, uninterrupted, or free of security vulnerabilities. We do not guarantee the accuracy of parking listings or the behaviour of third parties (Owners, alert senders).

10. Limitation of Liability

To the maximum extent permitted by applicable law, Parkly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of data, revenue, or any parking-related disputes between Users and Owners.

Our total liability to you for any claim shall not exceed the amount you paid to Parkly in the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Parkly and its operators from any claims, damages, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct we determine is harmful to other users or the Platform. You may delete your account at any time, free of charge, from Profile → Settings → Delete Account in the app, or as described in our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

14. Grievances and Complaints

For grievances relating to the Platform or to the processing of your personal data, please contact our Grievance Officer using the details in our Privacy Policy.

15. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. Material changes will be communicated where possible.

16. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of that provision.

Parkly is not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages of third-party providers, network or messaging failures, natural events, or government action.

These Terms, together with our Privacy Policy, Refund Policy, and Cancellation Policy, constitute the entire agreement between you and Parkly regarding the Platform.
